These terms govern your use of kafkalabs.com and the products and services offered by Kafkalabs, Inc. (“Kafka Labs”, “we”, “us”), including Turtle and Turtle Fast (together, the “Services”). By using the Services you agree to these terms. If you use the Services on behalf of a company, you agree on its behalf.
The Services
Kafka Labs is a research lab. Turtle is offered as a private beta and Turtle Fast is an experimental API offered to a waitlist. Both may change, pause, or be discontinued at any time, and features described on this site may be research directions rather than shipped capabilities. We will try to give reasonable notice of material changes to users with active accounts.
Accounts
You must provide accurate information when you create an account and keep your credentials secure. You are responsible for activity under your account. We may suspend or close accounts that violate these terms.
Acceptable use
You agree not to use the Services to:
- Make calls or send messages that violate telemarketing, robocall, call-recording, or consent laws, including the TCPA and state two-party consent laws, or that are harassing, deceptive, or fraudulent.
- Impersonate a person or organization, or misrepresent that a caller is human when the law requires disclosure.
- Access another person’s data or systems without authorization.
- Reverse engineer the Services or our models except where the law allows it.
- Resell the Services without our written permission.
You are responsible for the instructions you give a voice agent and for what it does on your behalf.
Your content
You keep ownership of the content you provide to the Services, including call audio and the data you connect. You grant us the rights needed to host, process, and transmit that content to provide and improve the Services, consistent with our Privacy Policy.
Intellectual property
The Services, including our models, software, and content on this site, are owned by Kafka Labs and its licensors and are protected by intellectual property laws. Except as these terms allow, you may not copy, modify, or distribute them.
Beta and experimental services
Beta and experimental services are provided for evaluation. They may contain errors, may be unavailable, and may lose data. Do not rely on them for emergency communications or safety-critical uses.
Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KAFKA LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
Indemnity
You will defend and indemnify Kafka Labs against claims arising from your content, your use of the Services, or your violation of these terms or applicable law.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these terms or if we discontinue a service. Sections that by their nature should survive termination will survive.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in San Francisco County, California.
Changes
We may update these terms. We will post the new version here and update the date at the top of the page. Continued use after a change means you accept the updated terms.
